Istanbul prosecutors seek securities freeze for 85 people in fund investigation

The reported 11 October request concerns asset preservation as fund liquidation and investor payments proceed under separate SPK rules. The record also includes disputed oversight allegations and restrictions on reporting.

The record

A request, with implementation still to establish

An 11 October 2026 letter from Istanbul prosecutors seeks restrictions on capital-market holdings belonging to 85 individuals, Ekonomim reported on 12 October.

The original letter, named list and any subsequent judicial decision were unavailable for this report. The value of the assets and the extent of implementation therefore remain unverified. The request does not establish criminal liability.

The operational boundary matters

Finansopia’s account describes consultation with prosecutors before unusual transactions, searches for property, vessels and aircraft, and exceptions for salaries, pensions, bills and ordinary business expenses. These are reported instructions; their application to individual accounts has not been independently verified.

For account holders, the critical distinction is between transfers that deplete assets and ordinary payments. The reported exceptions make that boundary consequential: compliance departments must identify transactions requiring scrutiny without treating every outgoing payment alike. The operative instructions and subsequent clarifications would show how that distinction is applied.

Two different groups numbered 85

An earlier request reported by TRT Haber, citing DHA, on 27 September covered 46 legal entities, 18 funds and 42 individuals. It described prosecutors’ allegations that purchases of shares through funds had helped drive up both share prices and fund valuations.

Separately, Justice Minister Akın Gürlek said on 6 October that 85 suspects had been remanded in custody and 207 people had faced proceedings, according to Bloomberg HT’s report of his remarks. Those figures must not be treated as the membership of the later 85-person list. The overlap between the lists has not been established.

Investor recovery follows a separate process

The Capital Markets Board’s 23 September notice identifies 131 funds from seven portfolio-management companies under the 17 September liquidation decisions, with 455,758 unique investors. That is a count of investors in the funds, not a verified count of fraud victims.

For funds established by Tera, Pusula, Atlas and Hedef, the SPK’s 1 October notice provides interim payments after reconciliation, capped at TL1 million per investor per fund and credited against final entitlements. The cap is not a promise of full recovery.

The 21 September amendment extended the specified liquidation period from three to six months while allowing earlier completion. A separate 1 October notice for A1 Capital, Bulls and Pardus sets conditions for liquidation and reopening certain other suspended funds. The rules must be read by fund and procedure, rather than as one universal payment timetable.

Oversight allegations and the regulator’s response

On 6 October, the SPK rejected a claim that it had ignored 130 warnings from Borsa Istanbul, disputing the stated number of notices and saying it evaluates incoming information and applies sanctions. This is the regulator’s response, not an independent audit of its handling of individual warnings.

The unresolved question is documentary: what information reached each authority, when was it assessed, and what action followed? A complete chronology would connect dated alerts, supervisory decisions and the transactions under investigation. Aggregate enforcement activity alone cannot resolve the handling of a particular alert; an allegation alone cannot establish regulatory neglect.

Restricted reporting and a published denial

bianet reported on 11 October that three articles covering MP Ahmet Şık’s fund-related questions and Gürlek’s legal response were blocked. It said the removal email did not include the reasoned court ruling. The legal reasoning therefore cannot be assessed from the notification described.

On the separate housing allegation, Medyascope reported on 29 September that Gürlek’s lawyer, Abdullah Adır, denied the claim and said the minister and his wife occupied ministry-assigned accommodation. He announced a criminal complaint and a damages action against Şık. The housing allegation remains disputed.

The outstanding questions

Which securities have actually been restricted, at what value, and under which operative decision? How are ordinary-payment exceptions and objections handled? Fund-by-fund reconciliation and payment reports would separately establish how much investors have received and what remains due.

The oversight question requires a dated trail from alerts to supervisory action. The reporting restrictions require the reasoned decision and any appeal outcome. Neither a freeze request nor the existence of a parliamentary allegation settles responsibility for the underlying transactions.
